BREAKING: Appeal Court upholds sack of Osun APC ‘Yes/No’ Chairmen,

The Court of Appeal sitting in Akure presided over by Justice Peter Obiorah has  dismissed the application by the local government chairmen elected on the platform of the All Progressives Congress ( APC)to relist an appeal filed against judgement of the Osogbo federal high given in favour of the Actions Peoples Party.
However,Justice Obiorah dismissed the appeal on Friday in a judgement given via zoom.

It will be recalled that the APC Chairmen had approached the court to relist the appeal dismissed on January 13, 2025 for want of diligent prosecution.

Following the February 10, 2025 judgement of the court that allowed their appeal, the APC in April approached the court to relist the appeal.

However,in  his judgment, Justice Obiorah said the appeallant who was pursuing a sister appeal before the same court can’t claim ignorance of the fact that it needed to file record before it.

The judgement reads: ” The
sudden attempt to resurrect this appeal over the decision of this court in sister appeal will only lead to confusion and this court will resist such attempt to lure it into unwittingly sit on appeal or review it decision on appeal CA/AK/270/2022.

Justice Obiorah, therefore stated that” Everything in this application shows that the third appeallant has not shown good course why this application should be granted. The fate as it has befallen them is self-inflicted. It’s therefore my conclusion that this appeal lacks merit and is hereby dismissed.”
